Terms & Conditions

Last updated: 22/08/2026

1. About These Terms

These Terms & Conditions govern your use of the TPES Architecture website and the information and services made available through it.

In these Terms:

  • "TPES Architecture", "we", "us" or "our" means Town Planning & Energy Solutions UK Ltd (TPES Architecture).
  • "Website" means the TPES Architecture website available at tpesdesign.uk.
  • "You" or "your" means any person accessing or using the Website.

By accessing or using this Website, you agree to these Terms & Conditions. If you do not agree with these terms, please do not use the Website.

These Website Terms do not, by themselves, constitute a contract for architectural, planning or other professional services. Where we provide services to a client, separate appointment terms, quotations or agreements may apply.

2. Our Services

TPES Architecture provides planning and architectural services which may include, depending on the service agreed with a client:

  • Planning application services
  • Planning drawings
  • Existing and proposed drawings
  • Residential extension design
  • Loft conversion design
  • New-build proposals
  • Commercial planning projects
  • Change-of-use applications
  • Design and planning advice
  • Other architectural or planning-related services

The exact services provided to an individual client will depend on the scope of work agreed with that client.

3. Website Information

We aim to ensure that the information provided on this Website is accurate and useful. However, planning requirements and procedures can vary depending on the property, location, proposed development and circumstances of an individual project.

Information on this Website is provided for general information purposes only and should not be treated as project-specific planning or legal advice.

Planning policies, legislation, guidance and local authority requirements may change over time.

You should contact us for advice relating to your specific project.

4. Planning Permission

TPES Architecture does not guarantee that planning permission will be granted.

Planning decisions are made by the relevant planning authority and may depend on matters outside our control, including:

  • Local planning policies
  • National planning policy
  • Site-specific circumstances
  • Planning history
  • Neighbouring properties
  • Consultation responses
  • Conservation requirements
  • Listed building considerations
  • Highways matters
  • Environmental considerations
  • Other statutory or non-statutory consultees

Where we submit or assist with a planning application, we will use reasonable professional care in carrying out the agreed scope of services.

However, the final decision rests with the relevant planning authority.

5. Quotations and Fees

Where applicable, we will provide clients with a quotation or fee proposal before commencing chargeable work.

The quotation will normally identify the scope of services and applicable fees.

Additional work outside the agreed scope may result in additional fees. Where reasonably practicable, we will discuss significant additional work with the client before carrying it out.

Planning authority application fees, survey fees, specialist consultant fees and other third-party costs may be separate from TPES Architecture's professional fees unless expressly stated otherwise.

6. Client Responsibilities

Clients are responsible for providing information that is reasonably required for us to carry out the agreed services.

This may include:

  • Accurate property information
  • Existing drawings or documents
  • Site information
  • Previous planning information
  • Property ownership information
  • Access to the property where required
  • Information about previous works
  • Any relevant restrictions or agreements known to the client

Clients should inform us if they become aware of information that could affect the proposed project.

We are not responsible for delays or additional costs arising from inaccurate, incomplete or late information supplied by a client or third party.

7. Surveys and Existing Information

Where our services rely on information supplied by a client or third party, we may rely on that information unless the agreed scope specifically includes verification or surveying.

If a measured building survey, structural survey, topographical survey, asbestos survey, ecological assessment, tree survey or other specialist report is required, this may need to be carried out by an appropriately qualified third party.

Unless expressly agreed otherwise, such specialist services are outside the scope of our services.

8. Planning Applications and Third Parties

Where TPES Architecture submits a planning application on behalf of a client, we may communicate with the relevant planning authority and other appropriate parties as necessary for the agreed service.

We are not responsible for delays caused by:

  • Planning authorities
  • Statutory consultees
  • Utility companies
  • Specialist consultants
  • Surveyors
  • Contractors
  • Other third parties

We aim to keep the Website available and functioning properly.

However, we do not guarantee that the Website will always be:

  • Available
  • Error-free
  • Secure
  • Free from viruses or other harmful components

11. Project Drawings and Designs

Drawings, designs and other professional documents produced for a client are subject to the terms of the relevant client appointment.

Unless otherwise agreed in writing, copyright and intellectual property rights in drawings and design work remain subject to the applicable professional agreement and intellectual property law.

A client must not assume that receiving a drawing automatically gives them unrestricted rights to reproduce, modify or use it for purposes outside the agreed project.
